Job description:
This position is not classified as a Civil Service role. Employees of the Detroit Water and Sewerage Department (DWSD) are required to abide by the stipulations outlined in the Court Orders issued by the United States District Court for the Eastern District of Michigan, Southern Division, under Case No. 77-71100, pertaining to specific terms and conditions of employment. Please note that DWSD does not recognize reversion rights for internal candidates.
The Senior Associate General Counsel plays a pivotal role in assisting the General Counsel and Deputy General Counsel by delivering expert legal strategy and counsel on matters affecting the DWSD. This position involves prosecuting and defending intricate legal actions, including cases of first impression, leading debt collection efforts, and addressing real property transaction issues such as surplus property, easements, encroachments, and vacations, among various other real estate transactions. The Senior Associate General Counsel will also be responsible for training and mentoring junior colleagues, drafting, reviewing, and interpreting legal documents, developing and implementing policies and procedures, and organizing tasks with a high degree of independent judgment, initiative, and discretion. A minimum of ten (10) years of relevant legal experience, along with strong research, writing, and litigation skills, is required for this role.
Essential Job Functions:
Acting as a senior legal policymaker, you will provide legal support to DWSD and its Board of Water Commissioners. Your responsibilities will encompass preparing, coordinating, and supporting DWSD’s representation in legislative and public processes. You will manage complex litigation and dispute matters for DWSD, including preparation for, prosecution, coordination, and representation in administrative and court proceedings regarding DWSD interests, as well as disputes affecting the City of Detroit, the State of Michigan, or federal jurisdictions. Additionally, you will lead collection actions directed by the General Counsel and oversee outside counsel representation as necessary. Investigations may be conducted or assisted, and you will be tasked with the research, drafting, preparation, review, and advisory roles concerning various legal documents. You will develop, coordinate, and implement legal strategies and negotiations to support DWSD’s business objectives and provide counsel for business initiatives. You will also exercise management authority delegated by the General Counsel when required, maintain an active membership in the State Bar of Michigan, and adhere to safety policies and procedures. A valid Michigan Driver’s License is mandatory, and you will be responsible for training junior staff members as directed by the General Counsel.
Examples of Duties:
You will be expected to prepare, conduct, support, and engage in both internal and external meetings. Administrative duties for the division may include file maintenance, data entry, and personnel management, among others. You will assist in managing vendor relationships, including those with outside counsel, and contribute to organizational training and material development. Periodic reviews of processes and procedures will be necessary to ensure functionality, and you may be assigned additional related duties as needed.
Knowledge Of:
- Proficiency in WestLaw and/or Lexis Nexis legal research systems.
- Fundamental principles, practices, methods, and techniques of Federal and Michigan law, including pertinent Court Rules and the Michigan Rules of Professional Responsibility.
- Proper confidentiality protocols.
- Experience with estate transactions and familiarity with financial controls and accounting principles.
